1. Acceptance
By accessing or using this website, submitting an inquiry, or communicating through a website form, you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use the website.
2. Operator
This website and the personal-training services described on it are operated by Nadya Jorand, a Florida sole proprietor (“Nadya,” “we,” “us,” or “our”). ART OF MOTION is a tagline only.
3. Informational Purpose
Website content is general information and is not medical advice, diagnosis, treatment, physical therapy, nutrition therapy, or a substitute for care from a qualified healthcare professional. Website content does not create a trainer-client relationship. A trainer-client relationship begins only after the applicable client agreement is signed and accepted.
4. Services
Nadya offers private, live one-on-one personal-training sessions in person and online. Availability, location, rate, travel charge, session length, and service dates are confirmed individually. Training at a client’s location may be unavailable or priced differently. No website statement guarantees acceptance as a client or continued availability.
5. Health and Safety
Physical exercise involves risk. Prospective clients must disclose relevant limitations, complete required screening, and obtain medical clearance when requested. Stop exercising and seek appropriate care if you experience chest pain, faintness, unusual shortness of breath, sudden pain, or another concerning symptom. In an emergency, call 911 or the applicable local emergency number.
6. No Guaranteed Results
Results vary based on health, attendance, effort, nutrition, sleep, genetics, and other factors. Testimonials and photographs describe individual experiences and do not promise that another person will achieve the same result.
7. Inquiries and Scheduling
Submitting an inquiry does not reserve a session. Nadya will contact the prospective client to discuss goals and availability. Complimentary calls and assessment sessions are subject to availability and are not an offer of unlimited free services.
8. Payments and Monthly Service Windows
Paid sessions are sold in service windows of no more than 30 days after payment. The number of sessions, rate, due date, location, and service-window dates appear in the signed client agreement or monthly confirmation. Unless expressly stated in a separate signed authorization, there is no automatic renewal or recurring charge.
9. Cancellations
The cancellation, late-arrival, rescheduling, expiration, and refund rules in the signed client agreement control. Website summaries are not a substitute for that agreement.
10. Intellectual Property
Website text, design, logos, photographs, video, and other original material are owned by Nadya or used with permission. You may view the website for personal, noncommercial purposes. You may not copy, republish, sell, scrape, train an automated system on, remove attribution from, or commercially exploit website material without prior written permission.
11. Acceptable Use
You may not interfere with the website, attempt unauthorized access, submit false or harmful information, impersonate another person, upload malicious code, or use the website unlawfully.
12. Third-Party Services
The website may use third-party hosting, forms, video, analytics, payment, scheduling, or social-media services. Their availability and privacy practices are controlled by their own terms. A link does not imply endorsement.
13. Website Availability
The website may be changed, suspended, or discontinued without notice. We do not promise uninterrupted, error-free, or completely secure operation.
14. Disclaimer of Warranties
To the fullest extent permitted by law, the website and its content are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, or availability.
15. Limitation of Website Liability
To the fullest extent permitted by law, Nadya will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of, or inability to use, this website. Nothing in these Terms limits liability that cannot lawfully be limited.
16. Governing Law
Florida law governs these Terms, without regard to conflict-of-law rules. Any court proceeding relating solely to this website must be brought in a court of competent jurisdiction in Broward County, Florida, unless applicable law requires otherwise.
17. Changes
We may update these Terms by posting a revised effective date. Material changes apply prospectively.
